DEPARTMENT OF BROADCASTING AND CINEMA

ON-CAMPUS IMAGE AND SOUND ACQUISITION GUIDELINES FOR UNCG

FACULTY, STAFF, AND STUDENTS

(Approved by the BCN Faculty on 23 March 2004)


Purpose

This document sets forth the procedure for UNCG faculty, staff, and students involved in shooting film, still photography, and videotape on UNCG’s campus and surrounding properties. The University and the Department of Broadcasting and Cinema are dedicated to providing a safe campus environment and to protecting the privacy of its students and employees.

Background

The University encourages faculty and students to participate in educational, documentary, and news gathering film work, photography, and videotaping activities.

Scope

These guidelines are applicable to any UNCG faculty member, staff person, and student engaging in on-campus audio recording, filming, photographing, and videotaping (hereinafter "shooting"). These guidelines shall not apply to:

  • UNCG students who are shooting under the direct and present supervision of a faculty member of the Department of Broadcasting and Cinema;
  • UNCG faculty, staff, and students or their parents or guests who are recording casual, avocational images and sound exclusively for personal use.

General Rules and Guidelines for Academically Related Shooting

It is the responsibility of each and every faculty member, staff person, and student to adhere to the appropriate legal, ethical, and professional standards for image and sound acquisition. All shooting must comply with North Carolina State Law and Federal Law. To acknowledge their responsibilities, faculty and staff engaged in shooting on campus and students registered for courses, including practicum, workshop, and independent study classes, shall be asked to sign the following Guidelines for Professional Image and Sound Acquisition. Faculty shall sign upon either initiation of employment or initiation of a project; students shall sign as part of the Academic Honor Code for each specific course registration involving image or sound acquisition, and students shall sign an additional copy provided at time of equipment checkout.

Guidelines for Professional Image and Sound Acquisition

By my signature below, I acknowledge that:

  • I must obtain consent in writing for any individuals whose likenesses appear in the film, videos, negatives, or photos, other than those individuals appearing in the background and are not readily identifiable--EXCEPT this requirement will not apply to UNCG students who, following contemporary professional practices, are reporting news as part of assignments in journalism or broadcast journalism courses (e.g., BCN 441 Electronic Journalism) or for campus media (e.g., Spartan TV);
  • I may not depict patently offensive sexual acts or use patently offensive language describing sexual acts, which are prohibited under North Carolina State Law or Federal Law;
  • I must not engage in conduct that violates North Carolina State and/or Federal Criminal or Civil Laws;
  • I must obtain written approval prior to shooting indoor locations that are residence halls owned by UNCG EXCEPT this requirement will not apply to UNCG students who, following contemporary professional practices, are reporting news as part of assignments in journalism or broadcast journalism courses (e.g., BCN 441 Electronic Journalism) or for campus media (e.g., Spartan TV);
  • I must obtain written approval prior to shooting indoor locations that are teaching and learning spaces of the University, or indoor facilities used by the University for business or recreational use. Prior written permission will not be required if:
    1. a UNCG faculty member who has access to the indoor facility for teaching is present and oversees the indoor shooting;
    2. a faculty member of the Broadcasting and Cinema Department is present and oversees the shooting;
    3. OR
    4. UNCG students who, following contemporary professional practices, are reporting news as part of assignments in journalism or broadcast journalism courses (e.g., BCN 441 Electronic Journalism) or for campus media (e.g., Spartan TV);
  • I will not identify The University of North Carolina at Greensboro in the visual works without the express written permission of the Dean of the Division of Continual Learning. Identification includes shots of campus or buildings that show or depict UNCG’s name, official watermark, seal, mascot, logo, or any other identifiable symbol associated with the University. If identification is approved, the University must appear in production credits and/or acknowledgements -- EXCEPT this requirement will not apply to UNCG students who, following contemporary professional practices, are reporting news as part of assignments in journalism or broadcast journalism courses (e.g., BCN 441 Electronic Journalism) or for campus media (e.g., Spartan TV);
  • I will negotiate directly with the property owners any agreements made regarding shooting on property not owned by UNCG but used by UNCG affiliated groups or programs, including, but not limited to, fraternities and sororities. Before signing the agreements, I will forward the agreements to the UNCG Office of University Counsel for review and approval pursuant to the UNCG Contract Review Policy; and in the appropriate situations, I shall consult with the University Police Department and/or the UNCG Office of Safety on issues of campus security and safety. EXCEPT this requirement will not apply to UNCG students who, following contemporary professional practices, are reporting news as part of assignments in journalism or broadcast journalism courses (e.g., BCN 441 Electronic Journalism) or for campus media (e.g., Spartan TV);
  • I acknowledge that I am not acting as an agent, representative, or employee of UNCG, and I hereby indemnify and hold UNCG harmless for any damage caused during a shoot.

To assist individuals in meeting their responsibilities under the guidelines provided above, the Department of Broadcasting and Cinema shall make available appropriate release forms for both individuals and locations. These will be distributed in classes and will be available in the Carmichael Equipment Room and in the Departmental Office in Brown.

Implementation

Alleged violations of the guidelines will be dealt with as appropriate through the normal channels:

For faculty and staff, administrative personnel review beginning with the most immediate supervisor.

For students, review and evaluation by the relevant course instructor with any serious violations of professional standards deemed to be a violation of the UNCG Honor Policy and referred to the UNCG Honor Court for appropriate action.

Request Procedure: Not Class or Academically Related, Identification of UNCG

A request in writing to the Division of Continual Learning, as set out below, must be made within ten business days prior to the proposed shooting date (waiver of this time period can occur upon special circumstances or hardships) in the following on-campus shooting situations:
  • Shooting that involves faculty or staff who are not shooting in connection with their employment with UNCG, but are engaged in independent shooting for commercial gain or out of employment by a third party at least in part because of their professional expertise in image or sound acquisition;
  • Shooting by students who are not shooting pursuant to academic or course requirements, and are not registered for a bone fide course requiring film or video acquisition;
  • Shooting by either faculty or students that identifies UNCG through shots of campus or buildings that show or depict UNCG’s name, official watermark, seal, mascot, logo, or any other identifiable symbol associated with the University, must submit a request in writing to the Division of Continual Learning, as set out below, within ten business days prior to the proposed shooting date (waiver of this time period can occur upon special circumstances or hardships)

The written request must state the following:

  • Name, address, and phone number;
  • All locations of the shooting;
  • The purpose of the shooting and if it is for a course assignment, the name of the course and the instructor;
  • A detail of the subject matter of the shooting and copies of any interview questions or script being used in the shooting;
  • The equipment and vehicles, if any, to be used in the shooting; and
  • A list of all individuals assisting in or participating in the shooting and state whether prior consent has been obtained to depict the participant’s likeness on film or video.

The written request must be submitted in triplicate to the Division of Continual Learning, UNCG, 1100 W. Market Street, Suite 300, PO Box 26170, Greensboro, North Carolina 27402-6170, which will process the request under the University’s general Film and Visual Representation Guidelines.
