Foreign nationals are required by federal law to obtain an employment-based visa to work in the U.S. It is vitally important that an international employee obtain the most appropriate visa status for the type of employment. Most visa cases require that UNCG petition to government agencies which are oftentimes experiencing backlogs and delays. It is important that departments contact the Office of the Provost far in advance of an anticipated start date so we have sufficient time to process the visa application or advise the foreign national on processing his/her visa petition. International employees may not undertake employment until the United States Citizenship and Immigration Services (USCIS) has authorized them for employment at UNCG. The Office of the Provost will contact the department as soon as the employee's visa petition is approved and notify the EPA Personnel Office so that they may be placed on payroll.
Departments should direct all questions regarding employment to a permanent position at UNCG to the Director of Immigration Services in the Office of the Provost. It is UNCG’s policy to prepare and submit employment-based nonimmigrant visa petitions for all permanent international EPA employees. No outside attorneys may represent UNCG in immigration cases without explicit permission of the NC Attorney General. Additionally, no UNCG official may sign USCIS Form G-28, Notice of Entry of Appearance as Attorney or Representative, on behalf of the University. All immigration-related petitions for which UNCG is the petitioner must be prepared and submitted by the Office of the Provost.
To initiate nonimmigrant visas for international employees, departments should contact the Office of the Provost to obtain the appropriate visa information packet. The packet contains forms for the department and the foreign national to complete and a list of information that the department and the foreign national must compile and submit to the Office of the Provost. The hiring unit is responsible for paying all filing fees associated with an employment-based petition for which UNCG is the petitioner.
