FERPA requires the University to obtain the student's written consent before it discloses non-directory information to a third party.
University must ensure security in computer access such that a student may only access his/her own education records.
FERPA allows the disclosure of information to the student by telephone if the school official can verify the student's identity. However, FERPA prohibits the release of non-directory information over the telephone to third parties unless there is an emergency or written student consent. We must ensure identity of student. G/R do not give information over the telephone.
If a third party provides a written consent from the student, the University official must inform the third party that he/she is not permitted to disclose the information to anyone else without the student's written consent.
Written consent is essential. Implied consent has been found in VERY limited circumstances, for example when the parent or student sues the University, the information is disclosed to a third party with a special relationship to the University which would be significantly adversely affected if the University is not able to refute the allegations.
